The Government adopted on Thursday a draft law transposing into national legislation the latest European regulations on the digitalisation of judicial cooperation and access to justice in cross-border civil, commercial and criminal proceedings, Government Spokesperson Ioana Dogioiu announced.
'The Government adopted the draft law amending Emergency Ordinance No 119 of 21 December 2006 on certain measures necessary for the application of Community regulations from the date of Romania's accession to the European Union. More specifically, the normative act transposes into national legislation the latest European regulations on the digitalisation of judicial cooperation and access to justice in cross-border civil, commercial and criminal proceedings, this means that parties involved in cross-border civil and commercial cases and their representatives may participate in proceedings, with the court's approval, by means of audio-visual telecommunications, provided that these means allow for the verification of the parties' identity and guarantee the security, integrity, confidentiality and quality of the transmission, as well as compliance with GDPR legislation. The person assisting or representing the party, the translator or the interpreter may also attend the hearing conducted by audio-visual telecommunications, even without being physically present with the party,' Ioana Dogioiu told a press conference at Victoria Governmental Palace.
