The Superior Council of Magistracy (CSM) announced on Wednesday that it has submitted the preliminary results of the questionnaire regarding the issues in justice, initiated by the Judges' Section, to the President of Romania, the Government and the Ministry of Justice.
"In the context of the initiative launched by the Judges' Section of the Superior Council of Magistracy regarding the consultation of the judiciary's professional body on current issues in the judicial system, we inform that the results of this consultation, namely the preliminary analysis of the questionnaire completed by judges regarding current issues in the judicial system, have been communicated to the President of Romania, the Romanian Government and the Ministry of Justice," a CSM release sent to AGERPRES informed.
Over 98% of judges who responded to the questionnaire on current issues in the judicial system reported having experienced a public campaign against the judiciary in the past year, the CSM said on Tuesday.
Moreover, the perception of the majority of judges surveyed is that the main cause leading to situations where the statute of limitations for criminal liability has been triggered is the passivity of Parliament.
The Judges' Section of the Superior Council of Magistracy has published a series of preliminary data collected from the questionnaire regarding issues in justice.
According to the Section, the questionnaire included 20 questions, 17 of which allowed for answers that could be automatically centralised, while 3 questions allowed open-ended responses (free text). Furthermore, completing all the answers was not mandatory, as some assumptions were not applicable to all judges, depending on their specialisation or the specific situations addressed by the questions.
Regarding public perception and institutional reactions to the judiciary, the Section reports that 98.1% of judges stated they had felt a public campaign against the judiciary in the past year.
Concerning the public reactions of the CSM to the ongoing public campaign, 67% of respondents expressed agreement with these reactions, 25% took a neutral stance and 8% disagreed, according to the CSM.
In the section addressing issues related to the continuity of panels, the data shows that 8.4% of respondents (192) reported being replaced from their panels, while 91.6% (2,081) were not replaced.
According to the data presented by the CSM, the majority of judges who responded to the questionnaire perceive the main cause leading to situations where the statute of limitations for criminal liability has been triggered as the passivity of Parliament.
The data also shows that, in an "overwhelming" proportion, judges consider the high workload and the lack of proper organisation to be the real problems that directly affect the administration of justice.
Similarly, in an "overwhelming" proportion, judges highlight that insufficient numbers of judges and clerks are impacting the activity of the courts, given the high number of cases.
Regarding the aspects affecting the organisational climate and the attractiveness of the profession, it can be noted that the constant reassessment of judges' status, along with the public discourse aimed at discrediting the judiciary and tarnishing the reputation of the judicial profession, are real issues that negatively affect the organisational climate and reduce the attractiveness of the profession.
According to the Judges' Section of the CSM, approximately 2,600 judges responded to the questionnaire on current issues in the judicial system, representing 56.5% of the total number of judges in office.
