ANCOM: New mechanisms activated in emergency situations for radio equipment and devices declared critical

The National Authority for Administration and Regulation in Communications (ANCOM) has put into consultation a draft decision that introduces emergency procedures for the circulation, conformity assessment and market surveillance of radio equipment and devices declared critical.

According to a press release sent to AGERPRES, the regulatory act transposes into national legislation the provisions of Directive (EU) 2024/2749, aiming to maintain the functioning of the internal market and the rapid provision of essential goods in times of crisis. The directive was adopted at European level in October 2024, setting the deadline for transposition as May 29, 2026.

The emergency procedure will be applicable only after the activation of the emergency regime on the internal market and only targets products designated as relevant goods in crisis situations.

The draft Decision proposes to amend and supplement Government Decision no. 740/2016 on the making available on the market of radio equipment and Government Decision no. 487/2016 on electromagnetic compatibility and will enter into force on May 30, 2026.

The National Authority for Administration and Regulation in Communications promotes the interests of users of electronic communications services, postal services and digital services in the context of the transition to the Gigabit society, by optimally capitalizing on the mix of administration and regulatory tools at the Authority's disposal.
