The exercise of constitutional powers by public authorities must be carried out in strict compliance with the principle of separation and balance of powers in the state, as enshrined in the Constitution, the judges from the Supreme Council of Magistracy (CSM) stated on Sunday, in reaction to the president Nicusor Dan's initiative to organise a referendum within the body of magistrates.
The Superior Council of Magistracy, in its constitutional capacity as guarantor of the independence of the Judiciary, exercises its powers autonomously and will not tolerate any form of interference, direct or indirect, in the activity of the judicial authority. Strengthening public trust in state institutions requires a responsible public discourse, anchored in constitutional norms and common European values, reads a press release of this forum sent to AGERPRES on Sunday.
"The Judges' Section of the CSM took note of the statements made by the president of Romania, Mr. Nicusor Dan, on Sunday, and emphasises that the exercise of constitutional powers by public authorities must be carried out in strict compliance with the principle of separation and balance of powers in the state, as enshrined in the Constitution of Romania," the abovementioned press release reads.
According to the same source, the referendum proposed by the president is not provided for by legal provisions within any profession, especially within the profession of judge, which represents one of the three powers in the state and has constitutional regulation, as well as at the level of organic laws.
"Any dysfunctions, if they exist, must find solutions in a stable social climate characterised by institutional cooperation, following analyses carried out in a rigorous and applied manner with regard to the importance of Justice in society, and not in a context characterised by emotional vectors, regardless of whether they appeared spontaneously or premeditated," states the press release sent by the Section for Judges of the Superior Council of Magistracy.
President Nicusor Dan on Sunday informed, in a press statement, that he will initiate a referendum within the body of magistrates in January with a single question: "Does the CSM act in the public interest or does it act in the interest of a group within the judicial system?"
