Romanian Senate ratifies Romania-Ukraine agreement on emergency mutual aid

Ata plenary session on Monday, the Romanian Senate passed a bill ratifying of the Agreement between the Government of Romania and the Cabinet of Ministers of Ukraine on cooperation in the field of prevention, containment and removal of the effects in case of emergencies signed in Bucharest on October 18, 2024.

There were 71 ayes and 31 presents.

The document proposed by the government and ratified by the Senate creates the necessary bilateral legal framework for Romania and Ukraine to provide mutual assistance, upon request, in the event of the imminence/occurrence of an emergency whose effects could not be completely removed by the efforts and means of the state whose territory is threatened/affected.

Under the agreement, the aid can be provided by making available to the requesting party aid teams, equipment, assistance and information, as well as any kind of response actions, expertise, search and rescue operations, which aim to save human lives, protect public health, contain material damage and cultural assets damage, as well as side effects, acknowledged by the parties.

Other forms of cooperation include: promotion by specialised bodies of the two countries of joint projects in the area of forecasting, prevention, evaluation, containment and removal of the effects of emergencies; conferences, field visits, scientific programmes, specialised courses, exchanges of experience, exercises and joint practical applications, through the cooperation of the relevant authorities, bodies of the states of the parties; the exchange of information on the sources of risk that may generate emergencies, in particular those that generate cross-border consequences affecting the territory of the other party's state; exchanging documentation on the results of the scientific research of the situations, the conclusions of the investigations into emergency causes , the evaluation of their effects and the necessary protective measures.

The agreement also says that the border crossing of the aid teams will be carried out with maximum celerity based on an individual or collective travel order issued on the head of the team and valid identity documents. In case of emergencies in the border area, the aid delivery teams may cross the state border, without formalities, in order to provide the necessary support, without the mentioned documents, in agreement with the border authorities of the state whose territory is affected.

Also, the population in danger/affected by an emergency may be temporarily evacuated to the territory of the state of the requested party, with the border crossing being made on the basis of their identity documents or, in the absence thereof, on the basis of a nominal list drawn up by the competent authorities of the requesting party and approved by the relevant representative of the border authority. The temporary evacuees are provided with subsistence and medical assistance.

The Senate is the decision-making chamber for the bill.
