Almost 3.6 million cases were pending in Romanian courts this year, amid a shortage of judges that fluctuated around 20%, the Superior Council of Magistracy (CSM) reported on Friday.
"The statistics prepared on December 16, 2025 show that in 2025, the courts had 3,578,860 files pending, of which 2,372,304 were newly entered files in the current year, compared to the same period of 2024 when 3,584,871 files were managed at the national level. Thus, the volume of activity of the courts in 2025 remained relatively constant compared to last year from the perspective of all the statistical indicators analyzed, whether reporting is done on newly entered files or on the total volume of files," the CSM states in a statement sent to AGERPRES.
According to the cited source, out of the total number of cases processed, the courts had a volume of activity of 2,652,160 cases, the tribunals - 709,213 cases, and the courts of appeal - 194,617 cases.
"On January 1, 2025, out of the total of 5,071 judge positions, 4,251 positions were occupied and 820 positions were vacant, registering an occupancy rate of 83%. Currently, 779 judge positions are vacant at the level of courts, taking into account all approved positions, including those allocated from the reserve fund," the Council shows.
The SCM says that the situation of vacancies was generated by the impossibility of organizing the competition for admission to the magistracy in 2025, given the provisions of art. VII of GEO 156/2024. Also, according to art. XXII para. (1) - (2) and (4) of Law 141/2025, the filling of vacant positions in public authorities and institutions through competition or examination is suspended in 2026.
"In conclusion, in 2025, Romanian courts managed a volume of activity of 3,578,860 files under conditions of a deficit of judges that fluctuated during the year around 20%," the Council emphasizes.
